By accessing or using RemoteBeat ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all users of the Service, including organizations, administrators, and individual developers.

2. Description of Service

RemoteBeat is a developer activity tracking and analytics platform designed for engineering leaders. The Service:

• Aggregates activity data from multiple development platforms (GitHub, GitLab, Jira, etc.)
• Provides analytics and insights about engineering productivity
• Enables cross-platform identity matching
• Offers team management and reporting features

3. Account Registration

To use the Service, you must:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Be at least 16 years of age
• Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

4. Developer Consent Requirements

As an organization using RemoteBeat, you must:

• Obtain explicit consent from developers before tracking their activity
• Clearly communicate what data is being collected and how it will be used
• Respect developers' right to withdraw consent at any time
• Comply with all applicable employment and labor laws
• Not use the Service for surveillance or micromanagement purposes

You are solely responsible for ensuring compliance with consent requirements in your jurisdiction.

5. Acceptable Use

You agree not to use the Service to:

• Infringe on the rights of others
• Harass, abuse, or harm developers or other users
• Distribute malware, viruses, or harmful code
• Attempt to gain unauthorized access to the Service or related systems

• Scrape or extract data using automated means without permission
• Remove or modify any copyright or proprietary notices

6. Subscription and Payment

Subscription Plans

We offer Free, Professional, and Enterprise plans. Plan details and pricing are available on our pricing page.

Billing

• Paid plans are billed monthly or annually in advance
• All fees are non-refundable except as required by law
• We may change pricing with 30 days' notice
• You authorize us to charge your payment method on a recurring basis
• Failure to pay may result in service suspension or termination

Free Trial

If you sign up for a free trial, you will not be charged until the trial period ends. You may cancel at any time during the trial.

7. Data Ownership and Usage

Your Data

You retain all rights to your data. We do not claim ownership of any data you submit to the Service.

Our Rights

You grant us a limited license to use your data solely to:

• Provide and maintain the Service
• Generate aggregated, anonymized analytics for product improvement
• Comply with legal obligations

Data Deletion

Upon account termination, we will delete your data according to our data retention policy (see Privacy Policy).

8. Service Availability

• You are responsible for complying with third-party terms of service
• We are not responsible for third-party platform availability or changes
• Third-party integrations may have additional costs or requirements
• We may add or remove integrations at our discretion

11. Termination

By You

You may cancel your account at any time through the Service settings or by contacting us. Cancellation takes effect at the end of your current billing period.

By Us

We may suspend or terminate your account if:

• You breach these Terms
• You fail to pay fees when due
• Your use violates applicable laws
• We are required to do so by law

Effect of Termination

Upon termination, your right to use the Service immediately ceases. Data deletion will occur according to our data retention policy.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Service will be uninterrupted or error-free

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REMOTEBEAT SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruptions or data loss
• Damages arising from unauthorized access to your account

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless RemoteBeat from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or violation of any rights of others.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration, except that either party may seek injunctive relief in court to protect intellectual property rights.

16. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Displaying a notice in the Service
